Stormwater BMPsStormwater Best Management Practices (BMPs) are implemented as a way of limiting and treating pollutants and other damaging effects of stormwater runoff in order to meet legislative and North Carolina Administrative Code requirements. There are two major categories of BMPs: non-structural and structural. Non-structural BMPs are typically passive or programmatic and tend to focus on source control and pollution prevention; reducing pollution in runoff by reducing the opportunity for the stormwater runoff to be exposed to pollutants. Structural BMPs refer to physical structures designed to remove pollutants from stormwater runoff, reduce downstream erosion, provide flood control, and promote groundwater recharge. Structural BMPs require engineering design and engineered construction.

Structural BMP Design: Section 6.1 of the Town Unified Development Ordinance (UDO) discusses Town stormwater regulations.  The Town has adopted the NC DWQ BMP Manual as their stormwater design manual.  Planting requirements for applicable BMPs can be found in the Town Design and Development Manual.

Structural BMP Construction Sequence: The Town has develolped a Structural BMP Construction Sequence to provide specific information for developers on what is required for structural BMPs prior to Final Plat/CO.

Structural BMP O&M Agreements: Each structural BMP in Apex is required to submit an Operation and Maintenance (O&M) Agreement to the Town prior to final approval.

Click on the appropriate to download the O&M Agreement for the applicable BMP.  An O&M Agreement is a required submittal to the Town prior to Final Plat/Certificate of Occupancy (CO).


Structural BMP As-Built Supplements: The Town requires a Structural BMP As-Built Supplement with each BMP As-Built drawing submittal. The purpose of the supplements is to ensure that as-built information for BMPs does not deviate significantly from design information. One supplement form is required for each BMP.


Structural BMP Annual Inspection Reports: All BMP owners are responsible for having all BMPs on their property inspected annually by a qualified registered North Carolina professional engineer, land surveyor, or landscape architect performing services only in their area of competence. Each BMP owner will receive a 30-day notice from the Town the month before annual inspection is due. Please follow these instructions for completing the inspection report(s).  Note that annual inspection reports submitted are subject to follow-up inspection by Town staff. Please contact Public Works at (919) 249-3427 for more information on structural BMP annual inspection reports.
